What we can do for you:
Help employers understand their I-9 obligations
In today’s climate of stepped-up workplace enforcement, companies must be extremely careful to comply properly with federal regulations regarding employment of those persons authorized to work in the United States. Employers must also be careful to keep the required records demonstrating compliance, as failure to do so can subject the employer to heavy fines. All employers must comply, not only those companies who employ foreign nationals. We can help you understand your obligations, identify areas of risk and show you how to develop procedures to avoid or reduce your risk.
Advice on obtaining temporary visas or work authorization
Where an employer has a legitimate need to employ a foreign national for a temporary period, we can advise you on lawful options for doing so. We can also assist in preparing necessary petitions or applications for the sponsored person. Jane Devlin has assisted many people to obtain temporary visas, including H-1B specialty occupation, L-1 multinational transferee, TN professional under NAFTA, E Treaty Investor, and R-1 religious worker.
Advice on obtaining permanent residence (green card)
Sponsoring a foreign national employee for permanent residence is a complex and delicate process, fraught with opportunities for error. Applicable federal laws and regulations can also change with little advance warning. In such matters, the advice of a seasoned professional is indispensable. Jane Devlin has helped many employers in sponsoring employees for permanent residence, and in choosing the most advantageous strategy for doing so. She has successfully obtained permanent residence based on labor certification as well as other categories. She has helped outstanding researchers and multinational managers to obtain permanent residence, as well as persons doing work which is in the national interest of the United States. She co-authored one of the first published works on the current system for labor certification: NEW PERMANENT FOREIGN LABOR CERTIFICATION (PERM) SYSTEM: A SUMMARY AND INITIAL ANALYSIS, published in Bender's Immigration Bulletin. She also co-authored the article, What Lawyers Need to Know about the new PERM Reg in Massachusetts Lawyers Weekly.
Jane Devlin has also helped many US citizens sponsor close family members for lawful permanent immigration status.
Advice on obtaining US citizenship
We also advise on citizenship matters, whether by naturalization in the US or through birth abroad to a US citizen parent.
